Constantine|Cannon LLP, along with five other leading antitrust and labor law firms, filed a landmark antitrust case in New York federal court today, aimed at exposing what plaintiffs allege to be egregiously anticompetitive collusion that targets teenage players across North America.

The class action lawsuit, which names as defendants the National Hockey League, the Canadian Hockey League, the Ontario Hockey League, the Western Hockey League, the Québec Maritimes Junior Hockey League, and each of those leagues’ member clubs, challenges the alleged systematic exploitation of teens pursuing their dreams of playing in the NHL.

In this historic litigation, plaintiffs allege that defendants conspired to: 1) restrain competition for players, rendering them nothing more than the property of the major junior teams that draft them; and 2) compensate those players at artificially suppressed, non-competitive levels. The case was filed by the World Association of Icehockey Players Unions North America Division, as well as two former major junior hockey players, who will seek to represent a class of similarly situated players. Here are some of the developments in antitrust news this past week that we found interesting and are following.

 

. The metaverse, shared virtual worlds accessible via the Internet, is the next digital market to attract regulatory scrutiny, EU antitrust chief Margrethe Vestager. The metaverse has come into sharper focus since Facebook changed its name to Meta Platforms two years ago to reflect its bet on the new sector as the successor to the mobile internet. That move has in turn triggered concerns about Meta’s possible dominance.

 

. Democratic Senator Elizabeth Warren has urged a U.S. regulator to reject Canadian Pacific’s $31 billion deal to take control of U.S. railroad Kansas City Southern, saying it would hurt competition, prompt job losses and disrupt service, a letter seen by Reuters showed. The acquisition, which combines the sixth- and seventh-largest U.S. railroads by revenue, was agreed in 2021. The deal has since closed but Kansas City shares were transferred to a trust and the railroad must operate independently until the Surface Transportation Board, which oversees U.S. freight railroads, approves the transaction.

 

. The U.S. Federal Trade Commission’s lone Republican commissioner, Christine Wilson, will step down from her role at the end of March, she said in a letter to President Joe Biden, in which she criticized FTC Chair Lina Khan. In addition, Holly Vedova, head of the agency’s bureau of competition, said she would retire after decades at the agency but did not give a date for her departure, according to a source familiar with her decision. Khan had named Vedova to run the competition bureau in September 2021 as part of her effort to reinvigorate antitrust enforcement.

 

. EU antitrust regulators narrowed their case against Apple, focusing on its App Store rules that prevent developers from informing users of other purchasing options, while dropping another charge related to in-app payments. The European Commission, which acts as the executive for the 27-country European Union, did not say why it had dropped its case against the iPhone maker for requiring developers to use its own in-app payment system. However, the victory for the U.S. tech giant will be short-lived as a new EU tech law known as the Digital Markets Act, which will apply from May, bans both of the Apple practices investigated by the Commission, with fines of up to 10% of a company’s global turnover for infringements.

Here are some of the developments in antitrust news this past week that we found interesting and are following.

 

. The U.S. Federal Trade Commission, which lost a fight in court over whether Facebook parent Meta Platforms Inc could buy VR content maker Within, has decided to withdraw the matter from its in-house adjudication. An FTC administrative law judge had scheduled a hearing for the matter for next week, which will now be canceled. But no final decision had been made on whether the agency will go forward at a later date.

 

. Sneaky fees have become a big part of America’s consumer economy. Hertz charges almost $6 a day simply for using a toll transponder in a rental car. Marriott and Hilton add nightly “resort fees” to the bill even at hotels that nobody would consider to be resorts. American, Delta and United list one airfare when you first search for a seat — and then add charges for basic features like the ability to sit next to your spouse. President Biden has announced a crackdown on these fees (which his administration calls “junk fees”), and he devoted a section of his State of the Union address to them.

 

. JetBlue officials are answering questions and giving depositions as the Justice Department presses on with its antitrust review of the company’s plan to buy Spirit, a small low cost rival, with a decision expected within weeks. “We want to be bigger. This is about jobs. This is about growth,” said Joanna Geraghty, JetBlue’s president and chief operating officer, pledging that a bigger JetBlue would put make it harder for the four airlines with 80% of the U.S. market to raise prices.

 

. The U.S. National Football League must face a $6 billion class action alleging it unlawfully limited televised games and drove up the cost of its “Sunday Ticket” package, a U.S. judge ruled. Sunday Ticket lets subscribers watch local and out-of-market games on Sunday, while football fans otherwise in any given market can only see a limited number of games. The case will be divided into two sets of plaintiffs classes – individual Sunday Ticket residential subscribers and commercial establishments, such as hotels and bars. The judge’s ruling said the entire class is likely to continue to be subjected to defendants’ “anticompetitive restraints on telecasts”.
